New Spanish FDI developing regulation
Through Royal Decree-Law 8/2020, of 17 March 2020, the Spanish Government amended Article 7 bis of Law 19/2003, of 4 July, to include a set of specific measures to control foreign direct investments (FDI) in Spain, further amended by Royal Decree-Laws 11/2020, 34/2020 and 20/2022 (Spanish FDI Regime).
The new regime has already been in place for over three years and the Spanish FDI Authority has been very active. In terms of developing regulations, an alignment with the latest European Union and Spanish legal updates was needed. Additionally, the need to clarify the circumstances triggering the regime itself set out in the law and the aim to provide greater legal certainty to investors, have led the Spanish Government to now adopt the Royal Decree 571/2023, of 4 July, on foreign investments (the Royal Decree 571/2023), which will enter into force on 1 September 2023.
